General User Terms

1. Introduction

We provide our platform, website and events (the “services”) and you want to use it for your purposes. These end user terms contain a right to use the Africa Cyber Gaming League platform and participate in our events subject to certain conditions. You will be liable for a beach of these terms if you use our services contrary to these conditions. If we find that you have breached these terms, then you may be liable to pay us damages and penalties.

 

2. Composition

These terms and our standard terms of service make up the agreement. These terms prevails over our terms of service where they conflict.

 

3. Acceptance

These terms regulate the use of the services by you. By registering for the service or exercising any rights granted to you under these terms, you accept and agree to be bound by these terms.

This agreement is between you, the individual or organisation that uses our services, and us, the owner of the services.

 

5. Our Services

(a)        As a commitment to our users, we currently provide you with access to a rich collection of online resources, including various communication and social networking tools, ladders, tournaments, leagues, news, reviews, personalized content and branded programming.  Certain services are presently provided free of charge, but it is possible that ACGL may charge for certain services in the future, subject to applicable laws.

 

(b)        We do our best to make your experience with the ACGL Service a pleasant one.  However, we cannot always foresee or anticipate technical or other difficulties.  These difficulties may result in loss of data, personalization settings or other service interruptions.  Therefore, you agree that the ACGL Service are provided on an “AS IS” and “AS AVAILABLE” basis. ACGL does not assume responsibility for the timeliness, deletion, non-delivery or failure to store any user data, communications or personalization settings.

 

(c)        ACGL reserves the right to change or discontinue, temporarily or permanently, the ACGL Service at any time.  You agree that ACGL will not be liable to you or any third party for any modification or discontinuance of the ACGL Service.

 

(d)        Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, or any user of the ACGL Service, are those of the respective author(s) or distributor(s) and not of ACGL neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made through the ACGL Service and expressly disclaims any and all liability in connection therewith.   

 

(e)        Your use of the ACGL Service is at your own risk.    

 

(f)        The ACGL Service may include hyperlinks to other websites or services solely as a convenience to you (“Third Party Sites”).  ACGL has no control over, does not endorse and is not responsible for any such Third Party Sites or the information, advertising, products, services or materials contained on or accessible through any such Third Party Sites.  You agree that ACGL is not liable for any loss or damage which may be incurred by you as a result of the availability of any Third Party Sites or as a result of any reliance placed by you on the completeness, accuracy or existence of any the information, advertising, products, services or materials contained on or accessible through any such Third Party Sites and your use of any such Third Party Sites or the services provided by them shall be governed by such terms between you and such Third Party sites.

 

6. Our intellectual property rights

We own copyright and other intellectual property rights in our services.

 

7. Grant of right

If you agree to the terms of this agreement, then we grant you a right to use our services subject to the conditions set out below. But, you may not use our services as if you own any rights in it. We do not grant you any right to use our services if you do not agree to the terms of this agreement.

 

8. Duration of right

This right starts to apply when you accept it and continues to apply until it terminates.

 

9. Right conditions

9.1 Non-exclusive. Your right to use our services is non-exclusive. We may give anyone else the same or any other right to use our services.

9.2 Non-assignable. Your right to use our services is non-assignable. You may not transfer the right to anyone else.

9.3 Your own purposes. Your right to use our services is only for your purposes. You may not use the services for anyone else’s purposes.

9.4 Duration. Your right to use our services is only for the duration of this agreement. You may not use the services before or after the duration of this agreement.

9.4 Fees. Some of our services may require you to pay a fee. You only acquire any rights related to such services upon payment of the fees. You will not have the right to use our services if the customer responsible for paying the associated fees (who may or may not be you) has not paid them.

 

10. Breach of right

You will be in breach of the right to use our services if you use it contrary to the conditions set out above.

 

11. Consent

By signing up for or otherwise using the services, you agree that we may collect, use, and disclose your personal information provided to us for the purposes of:

  • providing the services to you
  • administering your account on the services
  • handling any support tickets that you submit to us
  • improving the services for all users
  • and any other similar or connected purposes

We will process your personal information for these purposes in accordance with the relevant data protection laws and our privacy policy.

13. Feedback

We value your feedback about our services. It helps us improve it for you and our other users. But, please ensure that your feedback does not contain any unsolicited ideas. Definitions. In this clause:

  • feedback means any comments or suggestions you send us or post on a website that we control related to our services
  • unsolicited ideas means any original intellectual property related to our services or new goods or services that we have not asked you for in writing
  • No obligation to you. We are not obliged to compensate or credit you for your feedback in any way unless we have a written agreement with you to do so.

  • grant to us a perpetual, non exclusive, royalty free licence to use, reproduce and, modify your feedback for any purpose related to our goods or services
  • agree to deliver all documents and perform all actions necessary to ensure that our rights to use, reproduce, and modify your feedback are effective and enforceable
  • give up any claim that our use, reproduction, or modification of your feedback violates any of your rights, including your intellectual property rights or your moral rights (the rights not to have your work distorted and to be credited for your work)

fraudulent content – including offering, sharing or promoting false information relating to goods, services, or schemes, or otherwise misleading others in a way that is harmful or illegal

abusive content – including content that is defamatory or vulgar, infringes another’s right to privacy (such as their personal information), or is otherwise unreasonably or objectionable

destructive content – including content or software designed for the purpose of malicious damage to computers, systems, or data, or to control or otherwise access any of these things

17. Prohibited conduct

You may not use, or help others to use, our services or its services to interfere with the connections or security of networks, systems, or other users including:

unauthorized access – including accessing or attempting to access a network, system or user’s profile without permission

surveillance – including the surveillance of any data on a network, system or user’s profile without permission

intentional harm – including intentionally damaging the structure or efficient working of a network, system or user’s profile through physical or electronic means (such as Denial of Service attacks)

spam – including sending or promoting unsolicited mass electronic communications without permission

data manipulation – including the malicious and fraudulent altering of any data on or sent by a network, system, or user’s profile without permission

system manipulation – including the malicious and fraudulent alteration of a network, system, or user’s profile without permission

18. Investigation and enforcement

We will investigate any breach of these terms. During and after an investigation, we can alter or remove any content that breaches these terms, or share this content or related information with any relevant third party, including other users or law enforcement agencies. This section applies to any agreements that you have with us.

 

19. Your duty to report breaches

You agree to notify us of any breach of these terms, via email or any other reporting process that we have set up.

 

Specific User Terms

 

1. Individuals User Terms

User responsible for own account and users. You are responsible for the use and access of your ACGL account and to this end must ensure that only you have access to the platform and account. You will be held strictly liable for any content or activity conducted through your account, even if your account has been compromised, unless you have specifically informed us of the potential breach prior to the activity happening.

ACGL not party to any agreement with Clans/MGO’s . If you (or any users) are part of a Clan or MGO you may have certain responsibilities and agreements with that Clan or MGO. ACGL is not a party to any of those agreements and cannot be held responsible for any of the obligations under those agreements. If a Clan or MGO breaches the agreement or you are unsatisfied with the Clan or MGO’s performance under the agreement, ACGL will not be able to assist you.

ACGL not responsible for unaffiliated tournaments and competitions. Third parties, unaffiliated with ACGL may advertise, promote or run tournaments or competitions through the services. Entering into these tournaments or competitions will be subject to the third parties competition rules. ACGL is not a party to any of those agreements and cannot be held responsible for any of the obligations under those agreements. If a tournament or competition organiser breaches the agreement or you are unsatisfied with tournament or competition organiser’s performance under the agreement, ACGL will not be able to assist you.

 

2. Clan/MGO Terms

Clan/MGO responsible for own account and users. Clans/MGO’s (here after referred to as “teams”) are responsible for the use and access of their ACGL account and to this end must ensure that only correct users have access to the platform and account.

ACGL not party to any contract with users. When a user joins or becomes affiliated with your team, they enter into agreement between the team and the user.  ACGL is not a party to any of these agreements and cannot be held responsible for any of the duties or obligations arising out of the agreements. If the user breaches their agreement or the team is unsatisfied with the users performance of an agreement, ACGL will not be able to assist you.

ACGL not responsible for unaffiliated tournaments and competitions. Third parties, unaffiliated with ACGL may advertise, promote or run tournaments or competitions through the services. Entering into these tournaments or competitions will be subject to the third parties competition rules. ACGL is not a party to any of those agreements and cannot be held responsible for any of the obligations under those agreements. If a tournament or competition organiser breaches the agreement or you are unsatisfied with tournament or competition organiser’s performance under the agreement, ACGL will not be able to assist you.

Team responsible for own content and user content on site. Teams are strictly liable for any content, behaviour or breach of any of our terms by any users affiliated with the team. It is your responsibility is to ensure that your users follow and abide by our terms and policies. Should a user affiliated to your team breach any of our terms or policies we may take any appropriate action against you and the user in our sole discretion.
